VCDL Update 10/8/26 - another VCDL lawsuit filed

VCDL and GOA have just filed a new lawsuit challenging Virginia’s new prohibition on young adults (aged 18 to 20) being able to purchase either a handgun or an “assault firearm” anywhere in Virginia. We are requesting a Temporary Restraining Order and a Preliminary Injunction.


While the U.S. DoJ is saying the federal prohibition on handgun purchases by young adults is unconstitutional, we still must fight Virginia’s prohibition. Plus, DoJ’s position does not cover “assault firearms,” as young adults are not prohibited from purchasing them federally.

While the DoJ is saying carry in National Park Service (NPS) buildings that are open to the public is lawful, NPS has not yet changed their policy against carry in their buildings. So, for now, I would recommend waiting for that policy change to be made public. You will be advised here once that has happened.

A home invader left planet Earth after breaking into the wrong home in a normally quiet neighborhood in Portsmouth. With over 2.5-million gun owners in the Commonwealth, there are a whole lot of “wrong” homes that shouldn’t be invaded:

Two intruders who entered by an upstairs balcony got in a gun fight with the homeowner. The homeowner was not hurt, but he “tagged” one of the criminals, who was arrested when he showed up at a hospital with a gunshot wound. The police are looking for the accomplice. Too bad the accomplice wasn’t “tagged,” too.

A very sad story from Spotsylvania County about a 28-year-old woman who was murdered thinking that a protective order would keep her safe from her children’s estranged father. 


The father had been in and out of mental health facilities and had shared with health workers his “homicidal ideations,” which the health workers shared with police.


It took a long time, but the killer was finally served the protective order. The day before his court appearance was scheduled, he murdered his wife and killed himself. (Too bad he didn’t kill himself first and then murder his wife. These murder/suicide types always get it backwards.)


This story is just more proof that you are really on your own to defend yourself. Law enforcement cannot, or will not, protect you from an ongoing threat that could show up at some indeterminate time.

Our officers recently took another armed robber and illegal firearm manufacturer off the streets!


After a victim was robbed at gunpoint during an online-arranged Cartier watch sale at Tackett’s Mill, Officers quickly located the suspect’s vehicle and took the suspect into custody without incident.

 

A follow-up search warrant executed at the suspect’s residence uncovered a full illegal gun manufacturing setup, including: 

  • 3D printer, computer, and manufacturing equipment 
  • 2 fully assembled 3D-printed Glock-style handguns (including one converted to fully automatic) 
  • 4 3D-printed lower frames 
  • The stolen property and cash


What caused my eyebrows to go up was the claim that a 3D printer, computer, manufacturing equipment, 3D-printed Glock-style handguns, and 3D-printed lower frames are illegal. They are not.


Of course, the fully automatic Glock and the stolen items are illegal.


Perhaps the person was a felon and could not possess firearms. In that case, the police might have meant to say something like this, “The suspect has a felony record and a follow-up search warrant executed at the suspect’s residence uncovered a full illegal gun manufacturing setup that a felon cannot possess.”


If the suspect isn’t a prohibited person, then his set up would only be illegal if he is convicted and he becomes a prohibited person.




I have been seeing ads popping up on YouTube claiming that you can apply online for a new Virginia concealed handgun permit that will allow you to carry in all 50 states. The ads look professionally made, with real people talking, but it is all AI generated. The ads make various claims:


  • The permit was created by a new state law (yeah, like Grabigale would sign such a thing into law)
  • No training, takes minutes to get, and is honored in all 50 states (gee, how did VCDL miss that one becoming law in Virginia?)
  • The permits are only available for a short time, so apply now or you’ll miss the window! (The ads don’t want you to miss this great opportunity to get ripped off!)


A few months ago, I was contacted by someone who said they applied for one of these permits, paid the fee, but have never heard back from the company. I broke the bad news to him.


Recently, one of our Executive Members saw such a fraudulent ad pop up on YouTube and contacted Google to report it. Google just shrugged:


“We decided not to take this ad down. We found that the ad doesn’t go against Google’s policies, which prohibit certain content and practices that we believe to be harmful to users and the overall online ecosystem.”


Hah – so fraudulently taking someone’s money doesn’t go against Google’s policies? Interesting. Perhaps they shrugged because it’s just those “evil gun owners” getting ripped off?
