1. VCDL part of big win for gun rights out of the fifth circuit!
VCDL and GOA were part of a lawsuit challenging the ATF’s horrific Biden-era “Engaged in the Business” rule, that could get you charged as an unlicensed firearm dealer for merely selling a gun and making a profit. Or for listing a gun for sale, even if it didn’t sell!
Originally, we got an injunction. The Court said that VCDL, GOA members, and Texas residents were exempted from the rule. Last Friday a court in Texas put the final nail in the coffin of that rule, striking it down permanently for everyone!

The Lynchburg Commonwealth Attorney, Bethany Harrison, has announced that she is honoring his oath to protect and defend the Constitution by not prosecuting the unconstitutional “assault firearm” ban and carry prohibition!

If you live in Frederick County, you need to contact your Commonwealth Attorney, Ross Spicer (R), who signed onto an application with the Virginia Supreme Court to combine all four of the AWB lawsuits into one and move the case to Central Virginia! By doing so, he is joining forces with anti-gun “Two Bullets” Jay Jones to kill the AWB lawsuits!
That is NOT a good thing, and we need to ask him why he did that. He can help remedy that situation by removing his name from the application and publicly saying he won’t prosecute the new unconstitutional “assault firearm” ban and carry prohibition.

4. one of four virginia awb lawsuits takes a different angle
In Holloway v. Katz, an AWB lawsuit put together by previous Virginia Attorney General Ken Cuccinelli, the argument is that the AWB is unconstitutional because it forbids citizens from having the very firearms that the unorganized Virginia militia needs to fulfill its duties under the Virginia Constitution, Article 1, Section 13.
It’s an interesting, and, I believe, a valid approach. Dr. Edwin Viera, an expert on Virginia militias, had input on the lawsuit drafting as I understand it.
This lawsuit is scheduled to be heard this Wednesday in the Spotsylvania County Circuit Court.

5. reminder: SMLPSA is having a defensive pistol benefit match for vcdl on july 19th
The Smith Mountain Lake Pistol Shooting Association (SMLPSA) is having a Defensive Pistol match to benefit VCDL on July 19, starting at 10am for session one and 2pm for session two. Location:

The match is a defensive pistol “IDPA-style” match. SMLPSA has its own rule book, which is posted online on the registration page. (The rules are very similar to IDPA with a few minor changes: concealment garments are optional; no appendix holsters; all scoring on paper is limited - no make-up shots; and one or two other differences. The goal is to keep the rules simple and keep the stages fun without getting too complicated.)
Match Fee is $30 per shooter with $20 going to VCDL and $10 going to 4H to cover expenses.
There are going to be two sessions, a morning (10am-1pm) and an afternoon (2-5pm). Self-squadding is available on practiscore with a limit of 15 shooters per squad. Online registration is strongly encouraged, and a waitlist will be available. Due to the size of the range and time constraints there will be a limit of 30 shooters per session.
The match will consist of 6 stages. The total round count has yet to be determined but will be close to 100 rounds (it’s recommended to bring 150, but I’m not taking any chances and will bring 200!).
Sportsman’s Warehouse in Roanoke has kindly offered to sponsor the match and will have prizes to give out.

6. reminder: vcdl poll - who is virginia's best gun salesperson of the year?
Gun sales are through the roof in Virginia right now! Who should get credit for the, uh, “boom” in sales? Is it Abigail, Jay, Dan, Saddam, Garrett, or Scott?

7. the awb clock is ticking
A few things to think about has AWB Day approaches:
- If you don’t have a CHP, one handgun a month applies to you! If you want two AR pistols and don’t have a CHP, you can apply to the Virginia State Police for a permit good for 5 days to purchase more than one handgun at a time.
- Virginia is having record-level gun sales, with background checks taking longer consequently. Don’t wait until an hour before a gun store is closing to buy a gun! Be there early enough where a delay can be tolerated.
- Some gun companies have cutoff dates for orders from Virginia, based on shipping times to get the gun to the dealer before the end of June. For example, Daniel Defense is not accepting orders after June 19th.

Remember, I was in law enforcement in Texas for 7 years when I say this: don’t ask law enforcement about laws. Police know the laws they deal with on a regular basis. For example, they know that a felon in possession of a firearm is illegal. Do they know the details on the new laws that are going into effect on July 1? Perhaps, but not likely.
Questions about firearm laws is why we have groups like VCDL and firearms attorneys!
The General Assembly didn’t do anyone but Michael Bloomberg a favor by passing a ton of unconstitutional and confusing gun laws that are going to get some good people into trouble.

The Virginia Supreme Court has previously stated that Article 1, Section 13 of the Virginia Constitution is co-extensive with the federal Second Amendment. That is not what Jay Jones contends. He says that the Virginia Constitution does not protect the right of citizens to keep and bear arms! (I’m guessing Jay Jones believes in the Tooth Fairy, too.)
