1. awb lawsuit preliminary injunction was heard today in spotsylvania
One of VCDL’s Executive members attended the AWB lawsuit hearing today in Spotsylvania. The hearing was for Curtis v. Katz (I had mistakenly referred to this case in the previous alert as Holloway v. Katz) and is based on the militia clause of Article 1, Section 13 of the Virginia Constitution.
The hearing took four hours! The judge should issue his ruling soon, as July 1 is looming upon us.
2. vcdl/goa awb and carry prohibition being rescheduled for later in june
The Lancaster County judge is working to set a date later this month to hear our request for a temporary injunction on the AWB and AW carry prohibition. I’ll advise once a date has been set.
3. gun controllers mad as a wet hen over commonwealth attorneys and sheriffs not enforcing their unconstitutional awb crap ;-)
State senator Louise Lucas and Delegate Joshua Cole both are demanding that sheriffs and Commonwealth Attorneys violate their oath to support and defend the Constitution, just as Lucas and Cole have violated their oaths.
Lucas claims she will “fire” sheriffs and Commonwealth Attorneys who don’t enforce the new AW laws. A similar sentiment was stated by Cole.
There’s one problem and a huge amount of hypocrisy by Lucas.
First, there is a separation of powers issue. The Commonwealth Attorneys and sheriffs are all constitutional officers of the Executive Branch – elected by the People and answer only to the People. They are not appointed by the Legislative Branch, and they do not answer to the General Assembly. Lucas cannot “fire” them. Lucas needs to stick to selling marijuana and stop pretending she knows anything about the Constitution.
Second, Lucas, the ultimate hypocrite, was just fine when Commonwealth Attorneys refused to enforce marijuana possession laws, even passing a law that made such refusal binding on a judge.
