1. fairfax city is moving forward with a public hearing on a proposed gun-ban expansion

On September 30, the Fairfax City Council had a work session on a possible extension of their gun-free zones to include permitted, or should have been permitted, events and adjacent areas; an additional park; and to increase a violation from a Class 4 misdemeanor to a Class 1 misdemeanor.  There was also some discussion about CHP holders for purposes of a possible exemption.  It turns out there are over 3,000 CHP holders in the City!


 The Chief of Police did a presentation on any violations of the current law and provided information on CHP holders.


 In the last ten years there have been only three violations dealing with firearms in the areas where the existing ordinance bans guns.  Two were before the ordinance existed (in 2018 someone fired a shot into the ceiling of a community center but was never identified; and in 2019 someone reported an attempted robbery in a park the day after it happened and the suspects were never found).  The ordinance went into effect in 2021 and only one violation happened (in August of 2025 a CHP holder was reported to have a concealed handgun at an event in a park.  He was cooperative, said he was unaware of the prohibition, and turned over his handgun to the police for safekeeping so he could stay at the event.  He was cited and the Chief said he doesn’t know if the man has come to the police station to pick up his handgun yet).


 The Chief also noted that there have been no firearm related incidents at City permitted events in the last ten years, either.  He said that the average response time for a call dealing with a firearm is five minutes.  Well, that’s a good response time, but too long if something violent is happening NOW!


 One number that jumped out at me was when the Chief claimed that over 7,000 CHPs (out of over 700,000) had been revoked within the last year!  That is not even close to being correct!  According to the Virginia State Police, there have been 5,043 permits revoked since 2020.  I am betting the number the Chief had was over a 10-year period.  I don’t believe the Chief meant to mislead City Council, but this information needs to be corrected.  I have a call into the Chief. 


The Chief gave an advantage of not prohibiting otherwise lawful carry of firearms at permitted events: there can be a faster response time when an armed citizen is closer to an active violence situation than the police.


 The Chief had a list of four reasons that prohibiting carry would make things safer:

  •  A lawfully armed person might respond impulsively to a heated exchange.(This is so very rare with CHP holders as to be negligeable.)
  • A lawfully armed person intervening in a situation could do more harm than good.(This, too, is so very rare with CHP holders as to be negligeable.)
  • Police could be unable to determine who is the “good guy” from the “bad guy.”(In practice this is easy to do.Good guys will comply with lawful orders from law enforcement, bad guys won’t.I only know of one case where a CHP holder saved lives, only to be killed by a law enforcement officer by mistake.That was in Colorado a few years ago.)
  • Reducing fear and anxiety caused in some people by seeing someone else with a firearm.(If CHP holders are exempted and required to carry concealed, this won’t be an issue at all.)

 After the discussion, Council voted to have a public hearing in the future on the proposed ordinance as it currently stands.  The ordinance could be adopted as is, modified to do something like exempt CHP holders, or rejected entirely.  Once I have a date for the hearing, an Action Alert will go out.  In the meantime, I have sent an email to all City Council members with my comments on their work session.


2. ACTION ITEM: DOJ STILL MAKING ANTI-GUN DECISIONS

The U.S. Department of Justice/BATFE is a mixed bag right now.  Earlier this year President Trump issued an Executive Order to support the 2A, but I don’t think that AG Bondi is always following the intent of that order.

5. Thank you to nat weigle and ken modica for service in swva! new coordinator needed

Nat Weigle, who picked up the baton after Al Steed Jr. had to step down as the SWVA Gun Show Coordinator for health reasons, has now stepped down as well.  Nat, along with help from another SWVA stalwart, Ken Modica, did a wonderful job in keeping VCDL a presence in that part of the state.  Nat and his volunteers ran the VCDL tables at the Salem gun shows and various non-gun show events since the end of 2022.  Ken has been helping since long before that, as Al’s right-hand man.

 

Nat, Ken, and some volunteers ran the VCDL table at last week’s RRRC/VCDL benefit match, which, as always, was a ton of fun!  The weather ended up being perfect, with no rain.  Thanks to RRRC and Doug Cummins for making that match a success!

6. judge allows vcdl/goa lawsuit on gun bans in rest areas and abc stores to move forward

Good news!  While Republican Attorney General Jason Miyares is preferable to the Democrat candidate Jay Jones (see item #8, below), Miyares is still arguing that bathrooms and ABC stores are “sensitive” locations <eye roll>, as well as trying to delay our challenge to those locations in court. Fortunately, a Virginia Circuit Court Judge just rejected Miyares’s efforts to delay the case with a stay, and so we get to move forward.

9. a reminder to be cautious when loading/unloading a firearm

If there is going to be a negligent discharge of a firearm, it is likely to happen when loading or unloading it.  That’s why laws like the one that requires a gun to be unloaded when exiting your vehicle on school property is particularly dangerous and totally unnecessary.  Even Illinois doesn’t have that stupid requirement!

 

In this case, it is not clear if the person was unloading a gun in preparation for that gun to go into a safe, but that would be my guess as to what went wrong.  The man’s arrest photo shows the anguish on his face. 

 

Very sad and a reminder to all of us to be careful when handling firearms.

10. Cautionary advice on a recent gun-rights video

There are several videos on the internet that claim that there are ten new rules gun owners should know about based upon various court rulings, including rulings by the Supreme Court.  In my opinion some of the information in these videos is misleading and often completely wrong.  Following the video’s advice could land you in jail!

 

One video I saw references a “recent Supreme Court case” that I could not find anywhere.  Often, the video falsely assumes a Circuit Court ruling changes the laws nationwide and is already in effect.  Lower court rulings get appealed and reversed by higher courts all the time.

 

Here is an example of one such a video.  An item in this video basically says we now have national reciprocity and you should tell the New York police officer that has you pulled over that New York MUST honor your Utah CHP!  (Police officer to you: “Cool!  Now put your hands behind your back…”)

This video by Colion Noir discusses the importance of having at least a Level 1 or 2 holster when open carrying. Situational awareness, whether carrying openly or concealed is important, too.

 

For those who might not know what a Level 1, 2, or 3 holster is:

 

Level 1 holsters require a person to do one distinct movement to remove the gun from a holster.  You might either have to push a button or a lever, or pop a snap, to remove the gun from the holster.

 

Level 2 requires two distinct hand movements to release a gun from the holster.  For example, you might have to push down on a lever and then pull the lever backwards to remove the gun.

 

Level 3 requires three distinct hand movements to release a gun from a holster.  For example, you might have to push down on a lever, then push the lever forward, and then pull the lever backward to remove the gun.
