IMPORTANT Notes on AWB and Standard Capacity Magazines
two more sheriffs on the list!
VCDL suggests that if you still need either standard capacity magazines that hold more than 15 rounds or an “assault firearm,” that you continue to get those purchased and possessed before next Wednesday, July 1.
The reason we suggest that is:
- The VCDL/GOA win on a temporary injunction may be appealed
- The Washington County AWB lawsuit has not yet had a ruling released by the judge that heard that case
- The General Assembly and Governor are saying they are planning some kind of last-minute modification to the AWB law on Monday
- Also, in the highly unlikely case that we lose in the end, any AWs bought after July 1 might not be grandfathered
And this is where the sheriffs and Commonwealth Attorneys who say they won’t enforce these unconstitutional laws are critical. The State Police are enjoined from enforcing the AWB and AW carry law, so if you are carrying an AW, VSP won’t bother you and if your local CA and/or sheriff are not enforcing that law, then you are good to carry in those jurisdictions.
For those if you in Frederick County, your Commonwealth Attorney, Ross Spicer should now step up and protect you.
In the audio of Ross at the local Republican meeting held a few days ago, Ross claimed he has 27 years of prosecutorial experience and has a duty to prosecute any laws that the General Assembly passes. He does not! As VCDL pointed out in our open letter that prosecutors could sign onto:
At the outset, it is important to note that Commonwealth Attorneys are entrusted with discretion to decide whether to initiate and pursue criminal prosecutions for most criminal charges, including misdemeanor-level weapons-related violations. See e.g. Va. Code 15.2-1627(B) (Providing that Commonwealth Attorneys “may in [their] discretion, prosecute Class 1, 2 and 3 misdemeanors…”). That discretion includes consideration of constitutional authority, evidentiary sufficiency, the interests of justice, the fair allocation of limited prosecutorial resources, and other implications surrounding the charges considered.
And now that there is a judge in Lancaster County that believes that the VCDL/GOA lawsuit will likely prevail in striking down a presumptively unconstitutional AWB, Ross has even more confirmation that he should stand up and protect the rights of Frederick County.
WE NOW HAVE TWELVE SHERIFFS WHO WON'T BE ENFORCING THE UNCONSTITUTIONAL AWB AND AW CARRY PROHIBITION!
Sheriff Dan Smith of Patrick County and Sheriff Wayne Davis of Henry County have now been added to the list of sheriffs who are honoring their oath of office and protecting their constituents from unconstitutional gun-control laws! I missed important statements by both of them, and, thus, I am late in putting them on the list. VCDL thanks both sheriff’s for stepping forward!
