two commonwealth attorneys say awb won't be prosecuted!
What if the gun-controllers threw a party…
The “assault firearm” purchase ban and the “assault firearm” public carry prohibition is set to become effective on July 1.
…But the party got cancelled?
VCDL and GOA have filed a Temporary Restraining Order and a Preliminary Injunction on both laws, with the intent of keeping them from going into effect until they are finally adjudicated at some point in the future. Hopefully we will know soon if the court grants the temporary injunction.
Here the filings, done today, Monday, May 18, 2026:
Or …no one showed up?
So far, two Commonwealth Attorneys (CAs), upholding their oaths of office, have stepped up to the plate and publicly said those two “assault firearm” laws are unconstitutional and unenforceable! Those CAs are:
- Ryan Mehaffey, CA for Spotsylvania County
Mr. Mehaffey’s statement is here - Phillip Blevins, CA for Smyth County
News story is here
If a CA is not prosecuting violations of those unconstitutional laws, then there is no point in law enforcement in that jurisdiction arresting people over those laws either.
VCDL hopes that this is just the beginning and that we will see many more Commonwealth Attorneys, honoring their oath of office, stating that they will not be prosecuting those unconstitutional laws.
Commonwealth Attorneys are constitutional officers, elected by the People, and are not beholden to the General Assembly.
Meanwhile, hats off to Ryan Mehaffey and Phillip Blevins for protecting our constitutional rights!
Any other Commonwealth Attorneys want to proudly stand with the People and protect their right to keep and bear arms from unconstitutional attacks?
